Rolling Mountain Car Rental – Terms and Conditions

These Terms and Conditions ("Terms") govern the rental of vehicles from Rolling Mountain Car Rental ("Company," "we," "us," or "our"), operating in the United States Virgin Islands ("USVI"). By booking, reserving, or renting a vehicle from us, the renter ("Renter," "you," or "your") agrees to be bound by these Terms.

1. Eligibility and Driver Requirements

• Minimum renter age is 21 years old, unless otherwise stated.
• Drivers under 25 years old may be subject to a young driver fee.
• Renter must possess a valid driver’s license recognized in the USVI.
• An international driver’s permit may be required for non‑U.S. licenses.
• Only drivers listed on the rental agreement are permitted to operate the vehicle.

2. Reservation and Payment

• A valid credit or debit card is required at the time of booking and pickup.
• Full rental charges, taxes, and fees are due before or at vehicle pickup.
• A security deposit may be authorized or charged and released after the vehicle is returned, subject to inspection.
• Rates are subject to change without notice prior to confirmation.

3. Security Deposit

• The security deposit amount is determined by vehicle class.
• Deposits may be used to cover damages, fuel shortages, cleaning fees, tolls, tickets, or violations.
• Any remaining balance will be refunded within a reasonable time after return.

4. Vehicle Pickup and Return

• Vehicles must be picked up and returned at the agreed‑upon location and time.
• Late returns may result in additional daily charges.
• Vehicles must be returned in the same condition as rented, ordinary wear and tear excepted.
• Fuel level must match the level at pickup or a refueling fee will apply.

5. Vehicle Use Restrictions

The vehicle may not be:

• Used for illegal activities
• Used for racing, towing, pushing, or off‑road driving (unless authorized)
• Driven under the influence of alcohol or drugs
• Driven outside the island it was rented on without written approval
• Driven by anyone not listed on the rental agreement

Violation of these restrictions may result in immediate termination of the rental with no refund.

6. Insurance and Liability

• Renter is responsible for all loss or damage to the vehicle during the rental period.
• Basic insurance coverage, if included, is subject to limitations and deductibles.
• Renter may use their personal auto insurance or credit card coverage if applicable.
• Rolling Mountain Car Rental is not responsible for personal items lost, stolen, or damaged.

7. Accidents, Damage, and Theft

• All accidents, damage, or theft must be reported to us immediately and to local authorities when required.
• Renter must provide a police report for insurance claims.
• Renter remains financially responsible until the matter is resolved.

8. Traffic Violations and Fines

• Renter is responsible for all parking tickets, tolls, traffic violations, and fines incurred during the rental.
• Administrative fees may apply for processing violations.

9. Cancellations and No‑Shows

• Cancellation policies vary by booking type and rate.
• Failure to show up without notice may result in forfeiture of prepaid amounts.
• No refunds for early returns.

10. Cleaning and Smoking Policy

• Vehicles must be returned reasonably clean.
• Smoking or vaping inside the vehicle is strictly prohibited.
• Excessive cleaning, smoke, pet hair, or odor may result in cleaning fees.

11. Mechanical Issues

• Renter must notify us immediately of any mechanical issues.
• Unauthorized repairs are not permitted without approval.

12. Indemnification

Renter agrees to indemnify and hold harmless Rolling Mountain Car Rental from any claims, losses, damages, or expenses arising from the use or possession of the vehicle.

13. Limitation of Liability

To the maximum extent permitted by law, Rolling Mountain Car Rental shall not be liable for indirect, incidental, or consequential damages.

14. Governing Law and Venue

These Terms shall be governed by and construed under the laws of the United States Virgin Islands. Any disputes shall be resolved exclusively in the courts of the USVI.

15. Modifications

We reserve the right to modify these Terms at any time. Updated Terms will be posted on our website and apply to future rentals.

By renting a vehicle from Rolling Mountain Car Rental, you acknowledge that you have read, understood, and agreed to these Terms and Conditions.

Refund and Cancellation Policy

Effective Date: 12/12/26

At Rolling Mountain Car Rental, we aim to provide clear and fair cancellation terms. By making a reservation, you agree to the following refund and cancellation policy:

1. Same-Day Cancellations

• Cancellations made on the same day as the scheduled pickup are non-refundable.
• No refunds will be issued under any circumstances for same-day cancellations or no-shows.

2. 24-Hour Cancellations

• Cancellations made at least 24 hours before the scheduled pickup time are eligible for a 50% refund of the total booking amount.

3. 48 Hours (2 Days) or More

• Cancellations made 48 hours (2 days) or more before the scheduled pickup time are eligible for a full (100%) refund.

4. Refund Processing

• Approved refunds will be processed back to the original payment method.
• Please allow 5–10 business days for the refund to appear, depending on your bank or card provider.

5. Early Returns

• No refunds will be issued for early returns of the vehicle after the rental period has started.

6. Modifications

• Reservation changes are subject to availability and may affect pricing.
